The present Privacy Policy is entered into force as of October 24, 2023. By using Paycos Services you confirm your acceptance of the present Privacy Policy.

INTRODUCTION

Paycos is a brand owned and operated by Raggett Limited, a company incorporated under the laws of Cyprus under the number HE388466 with the office address at 84, Spyrou Kyprianou, 4004, Limassol, Cyprus.  Raggett Limited and its group companies and affiliates (hereinafter – “Paycos” or “We”) respect and value the privacy of each of its clients. Paycos is committed to protecting Your privacy and keeping your data safe.

The present Privacy Policy forms an integral part of the Paycos Website Terms and Conditions and describes policies and practices regarding our collection and use of Your personal data, as well as sets forth Your privacy rights.

Paycos recognize that personal data protection is an ongoing responsibility, and Paycos may from time to time update this Privacy Policy, as Paycos undertake new personal data processing practices.

“You” in this Privacy Policy may refer to a visitor of the Paycos Website (hereinafter – “Visitor”), a merchant, who intends to use or already uses our products or services, including any shareholders, beneficial owners, principals, directors, and staff members accessing our Website (hereinafter – “Merchant”), or a Client of a Merchant (hereinafter – “Client”). “Visitor” may include “Merchant” and/or “Client” where appropriate. Further clarifications on the matter are given in the present Privacy Policy sections.

WHAT PERSONAL DATA IS COLLECTED

Paycos may collect and process personal data about You, including information and documentation that You as a Visitor, Merchant or Client provide by filling in the Application form or the Contact Us form available at https://paycos.com (hereinafter – the “Website”) and information and documentation that You as a merchant provide us in order to conclude the Agreement. Such information may include but is not limited to the following:

  • name and surname
  • date of birth
  • passport or ID data
  • information about Your education
  • home, work or other physical address
  • e-mail address
  • telephone number, Telegram number and/or nickname
  • Your country of residence and work
  • the name of the company You work at, company registration number, Your current position and other employment information which You provide.
  • previous places of employment,
  • payment account number, information regarding the beneficial ownership in other companies.

Paycos reserves the right to use additional procedures and means to verify Your identity (Know Your Client) when providing services to You. This may include requests for provision of additional documents and/or information.

HOW WE USE PERSONAL DATA

Paycos use Your personal data in order to provide our services/products to You, in the capacity of a Merchant, and to respectively conclude contracts and carry out our contractual obligations. In this regard, we rely on a contract entered into by You and Paycos as the valid ground for the processing of Your personal data.

Paycos use Your personal data to enable You, in the capacity of a Client, to make use of Our services/products which we provide to the Merchant, e.g. make payments on the Merchant’s website. In this regard, We rely on the legitimate interests pursued by us.

We are also required by law to constantly carry out various activities for the prevention of fraud, money laundering and terrorism financing, as well as for compliance with other legal obligations. In this regard, we rely on the necessity to comply with legal obligations as the valid ground for the processing of Your personal data.

In addition, We process personal data in order to carry out various marketing activities and in this regard, we rely on Your consent as the valid ground for the processing of Your personal data.

Examples of how we may use Your personal data include:

  • to provide You with information, products or services requested from us;
  • to provide You with information, which we feel may interest You, provided that You have consented to be contacted for such purposes;
  • to notify You about changes to our products or services;
  • to ensure that content from the Website is presented in the most effective manner and to keep our Website safe and secure;
  • to allow You to use interactive features of our Website and to offer You a more relevant and tailored service;
  • to verify Your identity for legal/regulatory compliance purposes;

HOW LONG “PAYCOS” WILL KEEP YOUR PERSONAL DATA

Paycos will store Your personal data for the period necessary to fulfil the purposes listed above, unless a longer retention period is required or permitted by law.

Please be aware that we may be required to retain Your personal data for various legal or regulatory reasons, for example, to ensure that transactions are appropriately processed, settled, refunded or charged-back, as well as to investigate any potential fraud and to comply with anti-money laundering and counter-terrorism financing laws and other legal requirements.

While You are acting in the capacity of a Merchant or a Client, We will be required to retain your information in order to meet our legal and contractual obligations. However, when you cease using Paycos Services, We will still retain your personal information for a certain period of time. The grounds for that include, but are not limited to the following:

  • compliance with legal obligations under EU/local laws (for example, anti-money laundering legislation or licensing regulations);
  • protecting our legitimate interests, making or defending legal claims;
  • fulfilling our contractual obligations and rights in relation to the information involved;
  • ensuring conformity  with data processing and information security guidelines issued by relevant data protection authorities.

USE OF SERVICES BY MINORS

The services/products we provide are not directed to persons under the age of sixteen and we kindly ask such persons to not disclose their personal data to us.

HOW WE DISCLOSE PERSONAL DATA

In certain circumstances we may disclose the personal data we have gathered about You to the following categories of recipients:

  • Our group companies. In order to provide our services/products, we share personal data with our group companies. Raggett Limited is the entity responsible for the general use of personal data by other group companies in relation to the services/products provided under the brand name Paycos;
  • Third-party financial institutions. This may include card organizations and credit/financial institutions where You as a Merchant or a Client maintain Your payment account;
  • Our Merchants. We may disclose certain personal data, which you have provided to us or which we have received about you as a Client, to the relevant Merchants, in order to assist them with carrying out their legal obligations or their obligations towards you as their Client;
  • Our service providers. We may disclose certain personal data to the service providers who enable us to provide our services, such as companies that provide us with technological solutions, AML/CTF software, payment processing solutions.
  • Third-parties in relation to a legal obligation or if We are permitted to do so by law. In certain circumstances We may be legally obligated to disclose or share Your personal data with auditors, regulatory authorities or law enforcement bodies in order to comply with a legal obligation. We may also disclose Clients’ personal data, if it is permitted by law, in order to enforce or apply the Website Terms and Conditions or other agreements or to protect our rights, property, Clients or others.

Should We enter into any kind of a merger or business sale, the Clients’ information is likely to be included in the sale/transfer agreement, We will inform You hereof prior to the related personal data disclosure, We will ensure that Your personal information will only be used for the purposes outlined in the present Privacy Policy.

Your personal data may be transferred to and processed at a destination outside the European Economic Area (hereinafter – “EEA”). It may also be processed by staff operating outside the EEA who work for us or one of our service providers. Where such transfers of personal data take place, we have concluded either Standard Contractual Clauses or other appropriate safeguards, in order to ensure that Your personal data is treated in a secure manner and in line with this Privacy Policy.

YOUR RIGHTS

You have certain rights in respect to the way we treat Your personal data:

  • You are entitled to access Your personal data and receive information regarding Your personal data that we process. You can do so by either signing in to Your Client Interface account or by contacting us at paycos.com;
  • You are entitled to rectify the information we have about You if it is inaccurate. You can do so by either signing in to Your Client Interface account or by contacting us at paycos.com;
  • You are entitled to object to the processing of Your personal data;
  • You have the right to revoke Your consent for processing of Your personal data for the marketing purposes. We will inform You (before collecting Your data) if we intend to use Your data for such purposes or if we intend to disclose Your information to any third party for such purposes;
  • You may also request us to erase Your personal data or cease the processing of Your personal data. However, please note that this right may be subject to certain exemptions. Namely, in situations, where we are under a legal obligation to retain Your personal data, we will not be able to fulfil Your request and, in such an event, we will inform You accordingly;
  • You may also request us to provide Your personal data to You or transmit it directly to another controller and we will comply with such request, provided that the personal data processing previously carried out by us was based on Your consent or was necessary for the performance of a contract and where it is technically feasible;
  • You have the right to lodge a complaint to the Information Commissioners’ Office if You believe that we have not complied with the requirements of the General Data Protection Regulation with regard to Your personal data.
